Credits and Billing Terms

Terms for subscriptions, Credits, billing, refunds, and paid features.
This document forms part of the Humble Hammer Terms of Use.
Defined terms (such as Platform, Account, Credits, Business User and Consumer Law) have the meanings given in the Humble Hammer Terms of Use, which these Credits and Billing Terms form part of. If there is any inconsistency, the order of precedence in clause 3 of the Terms of Use applies.
1. What these terms cover
These Credits and Billing Terms apply when you purchase, receive or use paid features on the Platform, including subscriptions, Monthly Credits, Top-Up Credits, Purchased Credits, lead or enquiry fees, listing fees, promotional spend, and transaction or service fees. They expand on clauses 18 to 24 of the Terms of Use.
2. Prices, GST and disclosure
Before you purchase, we will display the material purchase terms, which may include the price, whether GST is included, the billing period, included features, usage limits, the initial term, renewal arrangements, cancellation instructions, any Credit requirements, any trial period, and any material eligibility or usage conditions.
Prices displayed to Australian consumers include GST where GST applies. Business Users are responsible for determining and meeting their own tax, invoicing, reporting and registration obligations. Humble Hammer does not provide tax advice.
3. Billing and payment
By completing a purchase, you agree to the terms presented at checkout. You authorise us and our payment providers to charge your selected payment method for the disclosed amount and any properly disclosed recurring charge.
You must keep your payment details current and ensure you are authorised to use the selected payment method. We will not impose a charge that was not disclosed or otherwise lawfully agreed.
4. Subscriptions and automatic renewal
Where disclosed before purchase, a subscription renews automatically at the end of each billing period until cancelled. The renewal period, the renewal price (or the method for determining it), and the cancellation method will be shown before purchase.
You may cancel an automatically renewing subscription through your Account settings or by contacting support@humblehammer.com.au. Unless the checkout terms state otherwise:
- cancellation stops the next renewal;
- access continues until the end of the current paid billing period;
- cancellation does not retrospectively refund an amount already properly charged; and
- you remain responsible for charges incurred before cancellation.
If a payment fails, we may retry the payment, request updated payment details, restrict paid features while payment is outstanding, or cancel or suspend the subscription after reasonable notice.
5. Types of Credits
Credits are platform credits issued by Humble Hammer for use with eligible features. We offer the following types of Credits:
- Monthly Credits — Credits included with a paid subscription, allocated at the start of each billing period as part of that plan.
- Top-Up Credits — Credits a subscriber may purchase to continue using features after the Monthly Credits for the current billing period are used up.
- Purchased Credits — Credits a user (including a Business User on a free plan) may purchase to access certain features without a subscription.
- Promotional Credits — Credits we issue free of charge, including referral, trial, bonus, compensation or goodwill Credits.
In these terms, Paid Credits means Top-Up Credits and Purchased Credits (that is, any Credits you pay for).
All Credits:
- may only be used for eligible Platform features described by us;
- are not legal tender;
- do not earn interest;
- are not held as a bank deposit on your behalf;
- cannot be redeemed for cash except where required by law;
- cannot be sold, transferred or traded unless we expressly permit it; and
- cannot be used outside the Platform.
6. How Credits are allocated and used
Monthly Credits are allocated at the start of each billing period for the relevant plan. The number of Monthly Credits included, the price of Top-Up Credits and Purchased Credits, and the Credits required for each feature are shown on the Platform and may change for future periods.
You are responsible for checking how many Credits a feature requires before using it. Once an eligible feature has been supplied or an enquiry has been validly delivered in accordance with the applicable Credit terms, the relevant Credits may be deducted.
Unless we state otherwise, when you use a feature we deduct Credits in this order: Monthly Credits first, then Paid Credits with the earliest expiry, then any remaining Promotional Credits. This is designed to help you use Credits before they expire.
7. Credit expiry
We will display the expiry that applies to your Credits before you buy them or when they are issued.
- Monthly Credits expire at the end of the billing period in which they are allocated and do not carry over to the next period, unless we state otherwise. They are included as part of your subscription for that period rather than separately purchased.
- Top-Up Credits and other Purchased Credits expire [Paid Credit expiry period] after the date of purchase, unless a longer period is disclosed at checkout or applicable law requires otherwise.
- Promotional Credits may have a shorter expiry, which we will clearly disclose when the Credits are issued.
We will not cancel valid Paid Credits solely because you have not used them before a period shorter than their disclosed expiry, and we will not charge a fee that reduces the value of your Paid Credits after purchase except as permitted by law.
If you cancel or downgrade your subscription, your Monthly Credits for future periods stop, but any unused Paid Credits remain available until their disclosed expiry, subject to clause 12 (Closing your Account).
8. Reversing or cancelling Credits
We may reverse, suspend or cancel Credits associated with a payment reversal or chargeback, payment fraud, duplicate or erroneous issuance, unauthorised Account access, abuse of a promotion, manipulation of the Credit system, or a material breach of the Terms of Use connected with the Credits.
9. Refunds
Except where required by law or expressly stated in the applicable purchase terms, fees are not refundable merely because you change your mind, do not use the service, fail to cancel before renewal, your circumstances change, or another user does not respond to you.
This does not exclude or restrict your rights under the Consumer Law, a remedy for an incorrect or unauthorised charge, a remedy where a paid service was not provided as agreed, a remedy expressly offered at checkout, or any other right that cannot lawfully be excluded.

10. Changes to prices and plans
We may change the price or inclusions of a subscription for a future renewal period and will give reasonable advance notice of a material price increase or material reduction in included paid features. A price change will not apply retrospectively to a period already paid for unless you expressly agree, the change is required by law or reflects a change in tax, or the checkout terms clearly permit a fair and reasonably necessary adjustment.
11. If we discontinue Credits or a paid feature
If we discontinue the Credit system or the core purpose of a prepaid service during its current paid period, we will provide a reasonable opportunity to use valid Paid Credits or another appropriate remedy. This may include continued access, a substitute service, account credit, conversion to an equivalent service, or a proportionate refund of the unused purchase value, subject to applicable law and deductions for Credits already used, refunded, charged back or fraudulently obtained.
12. Closing your Account
Closing your Account does not automatically entitle you to cash redemption of unused Credits. Any remedy will be determined under the Terms of Use, the applicable purchase terms and applicable law.
